These terms explain how FinQuick operates, how applications are considered and the basis on which our website and business funding services are provided.

1. About FinQuick
FinQuick is a trading brand of a company currently being incorporated in England and Wales. The company name, registered number and registered office will be added to this page as soon as incorporation is complete.
FinQuick provides commercial funding to eligible UK businesses. These Terms of Business apply to your use of finquick.co.uk, enquiries and applications made to FinQuick, and our dealings with you before any separate funding agreement is entered into.
2. Regulatory status and who we lend to
FinQuick is not authorised by the Financial Conduct Authority to carry on regulated consumer credit activities. Our funding proposition is intended for incorporated businesses and commercial purposes only. We do not offer consumer loans.
We do not intend to enter into a credit agreement where doing so would constitute regulated consumer credit activity for which authorisation is required. In particular, our standard proposition is not intended for individuals borrowing as consumers, sole traders, small partnerships or unincorporated associations where the proposed agreement would be regulated.
Commercial lending of this kind may fall outside the Financial Conduct Authority’s regulatory perimeter. Where a funding agreement is unregulated, the protections applying to regulated consumer credit will not apply. In particular, you should not assume that you will have access to the Financial Ombudsman Service or protection from the Financial Services Compensation Scheme in relation to the funding.
3. Eligibility
Our website describes our general funding proposition, but it does not constitute an offer of finance. Eligibility criteria may change and satisfying any stated criteria does not guarantee that funding will be offered.
We may consider information including the applicant’s trading history, turnover, cash flow, existing commitments, credit profile, ownership and management, purpose of funding and other information we consider relevant to our commercial assessment.
4. Applications and information you provide
You must ensure that information supplied to FinQuick is complete, accurate and not misleading. You must tell us promptly if material information changes while an application is being considered.
We may ask for supporting documents and information about the business, its directors, shareholders, beneficial owners or proposed guarantors. This may include identification documents, bank information, financial information and evidence relating to the purpose of funding.
5. Checks and assessment
To assess an application, prevent fraud and verify identity, we may carry out checks using information supplied by you and information obtained from third parties and public sources. This may include Companies House, credit reference agencies, fraud prevention agencies, identity verification providers and bank transaction or Open Banking information where you have chosen to provide access.
The type of credit search undertaken and any effect it may have on a credit file will be explained at the relevant stage of the application process where applicable.
6. Decisions and offers
FinQuick may accept or decline an application at its discretion, subject to applicable law. We are not obliged to provide reasons for a commercial lending decision except where the law requires us to do so.
Any indication of funding amount, term, repayment or pricing before a formal offer is illustrative only. A funding offer may be subject to conditions, further checks, satisfactory documentation and execution of the relevant agreements.
7. The funding agreement
If funding is approved and you decide to proceed, the legally binding terms of the facility will be contained in a separate funding or loan agreement and any related guarantee, security or other documents. Those documents will set out the amount advanced, total amount payable, repayment schedule, charges, events of default, rights on early repayment and any security or guarantee requirements.
If there is any conflict between these Terms of Business and a signed funding agreement, the signed funding agreement will take precedence in relation to that funding.
8. Fees, charges and repayments
We will disclose the pricing and material charges applicable to a proposed facility before you enter into the funding agreement. You should review the agreement carefully and make sure the business can meet the repayment obligations before signing.
Any consequences of late payment, missed payment, default or early repayment will be governed by the funding agreement.
9. Guarantees and security
Some facilities may require a personal guarantee, corporate guarantee, debenture or other security. Where this applies, it will be made clear before completion. Anyone considering giving a guarantee or security should consider obtaining independent legal advice before signing.
10. No financial, legal or tax advice
Information on this website and communications from FinQuick are provided to explain our commercial funding proposition and do not constitute financial, investment, legal, accounting or tax advice. You are responsible for deciding whether a facility is appropriate for your business and should obtain independent professional advice where appropriate.
11. Website information
We aim to keep information on this website accurate and current, but product features, criteria and availability can change. We do not guarantee that the website will always be available, uninterrupted or free from errors. Nothing on the website creates an obligation on FinQuick to provide funding.
12. Acceptable use and intellectual property
You may use this website only for lawful purposes. You must not attempt to interfere with the operation or security of the site, introduce malicious code, misuse forms or systems, or reproduce substantial parts of the site without permission.
Unless stated otherwise, the website content, branding, design and other intellectual property are owned by or licensed to FinQuick and may not be copied or commercially exploited without permission.
13. Third-party services and links
We may use third-party service providers in connection with applications, identity checks, credit assessment, payments, communications, analytics and technology. Our website may also link to third-party websites. We are not responsible for the content or availability of websites we do not control.
14. Data protection
We process personal data in accordance with our Privacy Policy. Please read it before submitting personal information to us.
15. Complaints
We want to resolve concerns fairly and promptly. Details of how to make a complaint and how we handle complaints will be set out in our Complaints Policy. For unregulated commercial lending, a complainant may not be eligible to refer the matter to the Financial Ombudsman Service.
16. Liability
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for fraud or fraudulent misrepresentation. Subject to that, FinQuick will not be responsible for indirect or consequential business losses arising solely from use of this website or reliance on general website information. Any liability arising under a funding agreement will be governed by that agreement.
17. Changes to these terms
We may update these Terms of Business from time to time. The latest version will be published on this page with the date of the most recent update. Changes will not retrospectively alter the terms of an existing signed funding agreement unless that agreement or applicable law permits it.
18. Governing law
These Terms of Business and any non-contractual obligations arising from them are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, subject to any different jurisdiction provisions contained in a signed funding agreement.
